All sales are final. Refunds are only issued in the rare case of product loss, extreme damage (with proof), or verified duplicate orders. Pre-sale items are refundable only until 48 hours before shipment. Shipping timeframes are estimates and not guaranteed. In Spite is not responsible for delays, address errors, or delivery rejections.

All performers are independent contractors operating under a signed waiver. In Spite is not liable for injury, misconduct, or events that occur outside the scripted nature of an act. No performer will impersonate law enforcement, military, medical, or any real authority figure.

We reserve the right to refuse service, reject orders, and alter item contents as needed for legality, safety, or brand alignment. We also reserve the right to laugh inappropriately at our own jokes.

Uploaded content must not be illegal, copyrighted without permission, or contain hate speech. Any submission violating these terms will be deleted without notice.

Performer Waiver

All talent and performers working under the In Spite brand agree to:
• Act solely as independent contractors.• Perform within legal, professional, and respectful boundaries at all times.• Waive all claims against In Spite and Gabe personally for any incident, injury, or claim arising during or after any scheduled gig, event, or delivery.• Understand that any costume or character performed must not impersonate real law enforcement or result in public confusion, panic, or confrontation.• Performers are not permitted to enter private property uninvited or escalate emotional situations.
All performers working with In Spite agree to:- Follow local laws and ordinances during public or private satire performances.- Avoid impersonation of authority figures (police, military, medical personnel).- Perform in a safe, lawful, and professional manner.- Sign a Performer Waiver prior to any booking.
In Spite assumes no liability for personal conduct outside the script or scope of the assigned service.

User Submission Policy

Users uploading photos, messages, or performance prompts to In Spite certify that:

• They own or have legal rights to use the content submitted.
• They understand that this material may be printed, delivered, recorded, or made public as part of a paid satirical service.
• In Spite reserves the right to reject or edit any submission deemed unsafe, hateful, defamatory, or in violation of laws.
• In Spite disclaims all liability for public reaction to the content submitted by users and will not be held liable for social, professional, or legal fallout.

Users may upload text, photo, or video content for use in customized orders.

By uploading:
- You confirm you have legal rights to use and distribute the content.
- You grant In Spite permission to use the content solely for order fulfillment.

Assumption of Risk & Release of Claims

All customers, clients, and performers using this site agree to assume full risk associated with the use of novelty entertainment services.
• You release and hold harmless In Spite, its owners (including Gabe), its contractors, partners, and any related entity from all claims, damages, lawsuits, losses, and liabilities, including attorney’s fees and legal costs, that may arise from your use of this site, your participation in events, or your purchases from this brand.• You understand that this site is not designed to solve personal problems, mediate relationships, or enforce justice.• In Spite is not liable for mail delivery delays, misunderstandings, emotional reactions, or social consequences that result from parody or prank-based material.

Shipping & Handling Disclaimer

Shipping is fulfilled by USPS, UPS, or a verified third-party courier. Most orders ship within 3–7 business days.

Flat-rate shipping applies based on product type and destination. Shipping ranges:
- Standard Items: $8–$15
- Oversized/NSFW/Discreet: $20–$30
- Custom Deliveries: Priced individually

Tracking numbers are provided when available. In Spite is not liable for delays once an item is in the hands of the carrier. Products labeled NSFW may include satirical language or provocative imagery unless 'discreet packaging' is selected.

We do not offer guaranteed delivery times unless otherwise arranged.

Refund Policy

At In Spite, all sales are considered final due to the custom, satirical, and novelty nature of our products and services.

We do not issue refunds for:
- Customer remorse or change of mind
- Items marked as delivered by shipping carriers
- Incorrect shipping information entered by the customer
- Displeasure with the content, tone, or comedic style of gag items
- Misunderstanding of what was ordered

**No Refunds Policy**
By placing an order, you acknowledge that all sales are non-refundable unless specifically listed as eligible below.

**Refunds MAY be considered only under the following circumstances:**
- An item was lost in transit and not delivered within 30+ business days
- A product arrived severely damaged (requires photographic proof within 48 hours of delivery)
- A duplicate order was placed in error within a 24-hour window (processing fees may still apply)

**Pre-Sale Items**
Refunds are permitted for any pre-sale product **only until 48 hours prior to shipment**. After that window, the order is locked, processed, and no longer refundable.

**Refund Process**
To initiate a refund request (if eligible), email us at info@inspite.fun with:
- Your order number
- Reason for the request
- Photo or documentation (if applicable)

All approved refunds will be processed to the original payment method within 5–10 business days. We reserve the right to deny any refund that does not meet the outlined criteria.

We do not offer partial refunds for unliked jokes, damaged egos, or broken relationships caused by satire.

Spite Club Subscription Terms

By enrolling in the Spite Club subscription, you agree to receive a monthly satirical mailer or prank package.
Subscriptions auto-renew monthly. Cancellation must be received at least 5 days prior to renewal date via email.
Contents of monthly packages vary and may include:- Satirical items (cards, stickers, gags)- NSFW-themed content (if user opted in)- Humorous or absurd packaging
Refunds are not issued for delivered subscription packages. Cancel at any time by emailing support@inspite.fun.

Performer Liability & Injury Waiver

Performers agree to waive and release In Spite, its founders, employees, and affiliates from any and all liability for personal injury, emotional distress, or damage incurred during or in relation to a performance, gig, or delivery.
All performers are independent contractors and assume full responsibility for their physical and legal safety while executing their assigned role. All acts must comply with local laws and avoid trespassing or impersonation of authority figures.

Gift Recipient Consent Policy

By sending a product or service to a third party through In Spite, you affirm that:- The recipient is legally eligible to receive mail/packages at the address provided.- You will not use our services to harass, threaten, or impersonate others.- You accept full responsibility for the tone and nature of the item being delivered.
In Spite does not verify recipient consent. You agree to hold In Spite harmless from any consequences or claims arising from the recipient’s reaction to receiving the item.

NSFW Consent & Age Policy

Some products and packaging may include crude humor, satirical insults, or adult-themed content.
Customers must be 18+ to place an order containing any product marked NSFW or adult-themed. By ordering, you confirm:- You are at least 18 years old.- You understand the comedic and adult nature of the product.- You are not ordering this item to entrap, endanger, or embarrass anyone unlawfully.
NSFW items are labeled clearly and require explicit opt-in at checkout.

Public Performance Notice

All public-facing performances, deliveries, or satire-based gigs coordinated by In Spite are intended to remain compliant with all municipal noise, safety, and loitering ordinances.
Clients are responsible for securing any required permits or permissions for public events or gatherings. In Spite reserves the right to cancel or reschedule any service if safety or legal standards are not met.

Customer Communication Agreement

By purchasing from In Spite, you consent to receive transactional emails related to your order, including:- Order confirmations- Shipping/tracking updates- Optional follow-up review requests
You may opt out of promotional or subscription-based messaging at any time. We will never spam, resell, or share your email address with third parties not involved in fulfilling your order.
